This agreement governs the relationship between the person who opens a free member account on the canturan.dev website (the “Site”) and the operator of the Site. An account cannot be created without accepting this agreement during registration.

2. Subject matter
This agreement sets out the rights and obligations relating to the free member account provided to the Member on the Site and its use. With a member account, the Member can:
- pay amounts agreed with the Service Provider in writing on the online payment page,
- view the history and status of payments made with the account,
- manage profile and contact details on the My account page.
Membership alone does not constitute the purchase of a service. Purchases of services are governed separately by the distance service contract and the written quote sent to the Member.
3. Membership conditions
- Members must be at least 18 years old and have full legal capacity. A person acting on behalf of a company confirms that they are authorised to represent it.
- The details requested at registration (first name, surname, email, phone, city and address) must be accurate, complete and up to date. If they change, the Member updates them on the My account page.
- Each person may open only one member account. The account is personal; it cannot be transferred or used by others.
- The Member must keep their password secret and choose a strong password not used for other services. Actions taken through the account are deemed to have been taken by the Member unless proven otherwise.
- A Member who suspects unauthorised use of their account or that their password has become known to others must change the password immediately and notify info@canturan.dev without delay.
4. Member obligations
When using the account, the Member agrees to:
- use the Site and the account only for lawful purposes and in line with this agreement and the terms of use;
- not register in someone else’s name or with false details;
- pay only with cards they are authorised to use;
- not attempt unauthorised access, automated bulk operations or anything that disrupts the Site, its servers or the payment infrastructure;
- not submit content or information that infringes the rights of others.
The Member is liable, within the limits of the law, for any damage suffered by the Service Provider or third parties as a result of breaching these obligations.
5. Rights of the Service Provider
- The Service Provider may temporarily suspend or close the account in the event of a breach of this agreement, misuse, suspected fraud or unauthorised card use, false information, or a request by a competent authority; where possible, the Member is informed by email with the reasons.
- To keep accounts secure, the Service Provider may take technical measures such as identity verification, password resets or ending active sessions.
- The Service Provider may temporarily restrict or change the Site and membership features for development, maintenance or security reasons. This does not affect rights under service contracts already concluded.
6. Personal data
Membership involves processing the first name, surname, email address, phone number, city and address, and the history of payments made with the account. The password is stored only as a one-way hash; the password itself is not kept anywhere and cannot be seen by the Service Provider. The session is handled with a strictly necessary first-party cookie.
Card data such as the card number, expiry date and security code never reaches the Service Provider and is not stored; it is processed only on the 3D Secure payment page of the bank or payment institution. The Turkish national ID number that may be requested under the payment services regulations is collected only at the payment step and is not kept in the member profile.
Details on the processing of personal data (purposes, legal grounds, recipients, retention periods and your rights) are set out in the KVKK data protection notice, the privacy policy and the cookie policy.
7. Online payments
- The online payment page can be used only after logging in with a member account and only for paying amounts agreed with the Service Provider in writing.
- Card payments are taken through the virtual POS of Türkiye Garanti Bankası A.Ş. (Garanti BBVA) and/or the infrastructure of iyzico Ödeme Hizmetleri A.Ş., a payment institution licensed by the Central Bank of the Republic of Türkiye, with 3D Secure authentication.
- Card details are entered directly on the payment page hosted by the bank or payment institution; they never reach the Service Provider’s servers.
- Rights and obligations relating to payment, withdrawal and refunds are governed by the distance service contract and the delivery and refund policy. Card payments are refunded to the same card through the provider that took the payment.
8. Electronic communications
The Member agrees to receive informational emails at the registered email address about opening the account, its security (for example password resets), payments and contract processes; these are not commercial electronic messages. Commercial electronic messages such as campaigns or newsletters are sent only with the Member’s separate consent under Law No. 6563. Notices sent to the registered email address count as written notice.
9. Termination and account deletion
- This agreement is concluded for an indefinite period. The Member may end it at any time by deleting the account on the My account page, without giving reasons or paying any fee.
- The Service Provider may terminate the agreement by notice and close the account if the Member breaches this agreement. The Service Provider may also discontinue the membership service altogether, in which case it informs Members reasonably in advance.
- When an account is deleted, profile data is deleted or anonymised. Payment, invoice and contract records are kept for the statutory period (generally 10 years) under Tax Procedure Law No. 213, Turkish Commercial Code No. 6102 and Turkish Code of Obligations No. 6098.
- Deleting the account does not affect rights and obligations under service contracts already concluded.
10. Changes to this agreement
The Service Provider may update this agreement in line with changes in the law or on the Site. The current version is always published on this page with its last updated date; material changes are notified to Members by email before they take effect. A Member who does not accept a change may end the agreement by deleting the account. Changes do not affect transactions already completed.
11. Evidence
The parties agree that, in disputes arising from this agreement, the Service Provider’s server, database and email records and the transaction records received from payment service providers constitute evidence under Article 193 of the Code of Civil Procedure No. 6100. This does not affect a Consumer’s right to prove otherwise.
12. Governing law and jurisdiction
This agreement is governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul (Central) have jurisdiction over disputes. Members acting as consumers may, under Consumer Protection Law No. 6502, apply to the consumer arbitration committee at their place of residence or where the transaction took place within the monetary limits announced by the Ministry of Trade, and to the consumer courts for disputes above those limits.
13. Entry into force
This agreement of thirteen sections is concluded electronically and enters into force when the Member completes registration on the registration form by ticking the box confirming that they have read and accept it. The date and time of acceptance are recorded by the Service Provider.
